Affidavit No 4 of Mr. Carten
This affidavit is filed for the purpose of providing the court with documentary evidence that supports many of the facts alleged by Mr. Carten in some of his other affidavits. The documents are appended as Exhibits A to I to the affidavit. At this time neither the Law Society nor the Government denies any of the facts.
Exhibit “A” is a copy of a legal opinion prepared for me by McCarthy Tetrault dated December 3, 1997.
Exhibit “B” is a copy of a document entitled “Police Report” that I prepared on December 10, 2002 and delivered to the RCMP and the Victoria City Police and the other recipients indicated on the front page.
Exhibit “C” is a copy of a document entitled “Second Police Report” that that I prepared on October 3, 2005 and delivered to the RCMP and the Victoria City Police and the other recipients indicated on the front page. A copy was hand delivered to Stephen Harper at a Conservative Party function in Vancouver on or about October 8, 2005.
Exhibit “D” is a copy of a list of investors for a private placement of share in W.C.W. Western Canada Water Enterprises Ltd that took place September 29, 1989 four days after the Government of British the Columbia entered into the September 25, 1989 agreement referred to in Exhibits B and C.
Exhibit “E” letter from Margaret Annett President Western Canada Water to Patrick Kinsella President Progressive Group dated August 21, 1990.
Exhibit “F” are copies of the several orders in council beginning with Order In Council No 331 that imposed and continued the moratorium on bulk water exports by marine tanker.
Exhibit “G” is a copy of a Cabinet Submission dated February 1991.
Exhibit “H” is an office copy of the Sun Belt Water Inc. Notice of Intent to file a Claim under Chapter 11 of the NAFTA dated November 27, 1998.
Exhibit “I” is an unsigned copy of the Sun Belt Water Inc. Notice of Claim and Demand for Arbitration under Chapter 11 of the NAFTA dated October 12, 1999
